Stellicare HIPAA Privacy Notice

This Privacy Notice outlines how Stellicare uses and discloses your Protected Health Information (PHI), your rights regarding your PHI, and our privacy protection practices. We are committed to protecting your privacy and ensuring the security of your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA).

How We May Use and Disclose Your PHI

We may use and disclose your PHI for treatment, payment, and healthcare operations without your written authorization.

Treatment

We may use your PHI to provide, coordinate, or manage your healthcare and related services, including sharing your PHI with other healthcare providers involved in your care.

Payment

We may use and disclose your PHI to bill and collect payment for the services you receive, which may involve sharing your PHI with your health insurance plan, government programs, or other third-party payers.

Healthcare Operations

We may use and disclose your PHI for necessary operations, such as reviewing the quality of our services, training purposes, and business planning to run our facility and ensure quality care. These operations also include:

  • Delivering and managing our services and website (improving functionality, personalizing user experience, providing technical support, and ensuring safety and security).
  • Communicating with you about your account, service updates, and training materials.
  • Business and administrative operations (internal reporting, risk analysis, quality control, user behavior analytics, and service performance improvement).
  • Compliance, legal, and regulatory purposes (audits, financial reporting, contract enforcement, and dispute resolution).
  • Preventing misuse and ensuring compliance (monitoring for fraud, violations of our policies, and protection against unauthorized access).

Other Lawful Uses

We may also use or disclose your PHI for other purposes allowed or required by law, including public health and safety; health oversight activities; judicial and administrative proceedings; law enforcement and government functions; workers' compensation; and research, subject to strict safeguards that ensure the privacy of your PHI.

Authorization

Any other uses and disclosures of your PHI will only be made with your written authorization, which you may revoke at any time.

Your Rights Regarding Your PHI

  • Right to Access: You have the right to inspect and obtain a copy of your PHI that we maintain by submitting a written request to our HIPAA Compliance Officer. We may charge a reasonable, cost-based fee for providing the copies.
  • Right to Amend: You have the right to request an amendment to your record if you believe the PHI we have is incorrect or incomplete.
  • Right to an Accounting of Disclosures: You have the right to request an accounting of certain disclosures of your PHI made by us.
  • Right to Request Restrictions: You have the right to request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations.
  • Right to Request Confidential Communications: You have the right to request that we communicate with you about health matters in a certain way or at a certain location.
  • Right to a Paper Copy of This Notice: You have the right to obtain a paper copy of this notice upon request.
  • Right to Designate Someone to Act on Your Behalf: If you have granted someone medical power of attorney or a legal guardian has been appointed, that person may exercise your rights.

Privacy Protection Practices

We maintain physical, administrative, and technical safeguards to protect the privacy of your PHI. These measures include physical safeguards (securing facilities and workstations), administrative safeguards (policies and procedures for our workforce), technical safeguards (secure electronic systems, access controls, encryption, and secure infrastructure), and breach notification — we will promptly notify you if a breach occurs that may have compromised the privacy or security of your information.

Data Retention

We retain your data only as long as necessary — PHI for 7 years (HIPAA), account data for 2 years post-closure, logs for 12 months, and payment records for 7 years. Data is securely deleted or anonymized thereafter.

Data Deletion

You may request deletion of your personal data by emailing us at tapan@stellicare.com. Requests are processed within 30 days. Some data may be retained where legally required under HIPAA or applicable regulations.

How to Exercise Your Rights or Lodge a Complaint

If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services (HHS). You will not be retaliated against for filing a complaint.
